3、Qualification Requirements For Bidder
Qualifications or Performance:The qualification documents submitted by the bidders to prove their ability to fulfill the contract upon winning the bid should include the following:
(1) If the goods provided by the bidder under the contract are not manufactured by the bidder itself, the bidder should obtain a valid authorization letter from the manufacturer authorizing it to provide such goods in this bid (refer to Chapter 4, Section 4 of the "Bidding Document", Form IV-9-4) or an authorization letter from an authorized agent with the authority to represent the bid product (and the bidder must provide relevant proof documents showing the completeness of the authorization chain of the manufacturer for the bid product; when determining the number of bidders, if the bid products of more than two (including two) bidders are produced by the same manufacturer or integrator, they will be regarded as one bidder. For more than two integrators or agents using the same manufacturer's products as part of their project packages and the total price of the same products exceeds 60% of the respective bid total prices of the packages, they will be regarded as one bidder).
(2) Power of attorney of the unit's responsible person;
(3) Original or copy of the credit certificate issued by the bidder's bank three months before the bid opening date.
"Other qualification documents" refer to the documents proving that the bidder and its cooperating parties meet the following qualification and capability requirements:
(1) The manufacturer can independently participate in the bid. Domestic manufacturers within the territory of China must have valid business licenses and medical device production licenses; foreign manufacturers must be legally registered in the country.
(2) The national general agent, regional agent, or the agent listed in the medical device registration certificate or registration form (hereinafter referred to as the agent) can also participate in the bid. The national general agent or regional agent must have an agency certificate and be valid.
(3) Dealers (or agents) authorized by the manufacturer or the national general agent or regional agent or the agent can also participate in the bid.
(4) Domestic distributors (or agents) and the national general agent or regional agent or agent authorized by them must have valid business licenses and medical device operation licenses; foreign distributors (or agents) must be legally registered and authorized by the manufacturer.
(5) The bid product must obtain a medical device registration certificate.
(6) If the bidder is a domestic enterprise, it must also meet the following conditions: it must not be included in the "untrustworthy executors" on the website of Credit China (www.creditchina.gov.cn), the "blacklist of tax violations" on the China Government Procurement Network (www.ccgp.gov.cn), or the "serious illegal and dishonest behavior record list of government procurement" on the China Government Procurement Network.
